Legal Implications of Abuse of Authority in The Issuance of Nickel Mining Business Licenses in The Raja Ampat Islands

This article discusses the issuance of Nickel Mining Business Permits (IUPs) in the Raja Ampat Islands, which are known as a global biodiversity hotspot. However, the region has recently faced serious threats due to mining activities that are damaging the environment. The issuance of nickel IUPs on five small islands is suspected of violating various laws and regulations that protect the environment in coastal areas and on small islands, as well as spatial planning regulations. Based on the results of the analysis, it was found that the permits issued do not comply with spatial planning regulations, disregard environmental aspects, and contradict other applicable laws and regulations. The issuance of these IUPs constitutes an abuse of authority that involves unlawful acts. The legal implication of these unlawful acts stemming from the abuse of authority is that they are invalid. Furthermore, government officials involved in the issuance of the IUPs must be subject to both administrative and criminal sanctions. This article underscores the need for a comprehensive approach to law enforcement—encompassing both administrative and criminal measures—to ensure accountability and environmental protection in the Raja Ampat Islands.
